Below, we describe the processing of your personal data and your rights under current data protection legislation - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, and the regulations implementing it, hereinafter referred to as the "Data Protection Regulation" or "GDPR".

In any case, Fertoolity shall act as the party responsible for the processing of the personal data managed by the clients of the same in relation to the services provided through the platform, and the parties responsible for the processing of said data and purposes shall be the clients of the same.

2. What personal information will we collect?

We are a company specialized in the creation of new systems, applications and services related to assisted reproduction and fertility, however, through this Privacy Policy we only inform you of the activities or interactions that are carried out through this website, without collecting any data other than those indicated below:

  • Identification data (Name, Surname, Telephone, email, Company, City), to allow the registration of authorized users.
  • Information on products or services and attention to incidents that have occurred.
  • Information on any queries or doubts you may have.

3. For what purpose(s) will we process your data and on what legal basis?

Your personal data is processed, in accordance with the provisions of the GDPR, on the legal basis and for the purposes set out below:

a) Execution of the Contract (art. 6.1.b. of the GDPR)

The processing of your personal data will be carried out, by virtue of the contractual relationship between both parties, for the following purposes:

  • Enable the registration of users on the platform, as well as its optimal use.
  • To respond, in the first instance, and follow up on the queries/requests you have made to us through the contact channels (web, email or telephone).
  • To deal with any technical issues that you may raise with us in relation to any incidents that may occur in connection with the use of the platform.
  • To limit itself to carrying out the actions that are necessary to provide the CUSTOMER with the contracted Service, in accordance with the provisions of the corresponding Contract.
b) Consent of the Data Subject (art. 6.1.a. of the GDPR)
  • To carry out commercial, informative, and informative communications free of charge, both by electronic and non-electronic means.

You may revoke such consent at any time. In this regard, it should be noted that the revocation of the consent given will not affect the lawfulness of the processing carried out prior to the withdrawal of such consent.

c) Automated individual decisions

We do not use fully automated decision-making processes as described in Article 22 of the GDPR. In the event that we do use such a procedure from time to time, you will be informed of this and have the right to obtain human intervention in the decision-making process and, where appropriate, to know the underlying rationale for the decision.

d) Finally, as Data Processor,

It will use the information stored to enable the proper use of the Platform and the storage of the information corresponding to the clients who contract its use, being the Data Controllers in relation to the processing carried out through the Platform.

4. To which recipients will your data be disclosed?

In order to carry out all the purposes described above, Fertoolity, S.L.U., relies on the collaboration of third party service providers, who may have access to personal data as a consequence of the execution of the contracted services. In any case, Fertoolity, S.L.U., follows strict selection criteria for these third parties in order to comply with its data protection obligations and signs the corresponding data protection agreement with them, where these third parties are obliged to comply with their data protection obligations, and specifically, to comply with the legal, technical and organisational measures, to process personal data for the agreed purposes, and the prohibition of processing said personal data for other purposes or transfer to third parties.

Additionally, Fertoolity, S.L.U., will be able to reveal the personal data and any other information of the Client or user when required to do so by public authorities in the exercise of the functions that are legitimately attributed to them and in accordance with the applicable provisions.

5. How long will we keep your data?

Fertoolity, S.L.U as a general rule will keep your information only for as long as it is relevant and useful for the purpose for which it was originally collected. However, and in relation to the provision of services, personal data will be kept for the duration of the service and for at least 6 years after the end of the contractual relationship.
Fertoolity, S.L.U., will comply with the provisions of current legislation regarding the duty to delete personal information once the intended purpose has been achieved, or when you revoke your consent to the processing of the same, remaining at the exclusive disposal of Judges and Courts, the Public Prosecutor's Office or the competent Public Administrations for the attention of possible liabilities arising from the processing, and only during the periods of description of said liabilities. Once these periods have elapsed, this information will be definitively deleted using secure methods.

6. How did we obtain your data?

The personal data that Fertoolity, S.L.U., processes are the personal data collected through the different contact channels provided and which have been directly provided by the interested parties.

7. What are your rights when you provide us with your data?

In accordance with the provisions of the General Data Protection Regulation, as well as national data protection regulations, you have the right to exercise, if you so wish, the rights of access, rectification and deletion of data, to request the restriction of the processing of your personal data, to object to the processing, to request the portability of your data, as well as not to be subject to automated individual decisions.
In addition, in the event that the processing of personal data described above is based on your consent, you may revoke such consent at any time. In this regard, it should be noted that the revocation of the consent given will not affect the lawfulness of the processing carried out prior to the withdrawal of such consent.
